CA orders 1-year minimum warranty on all refurbished phones & laptops - tech-ish

If you have ever bought a phone or laptop in Kenya, chances are you know the drill. You head to a small stall along Luthuli Avenue in Nairobi, a shop in Kisumu or Mombasa, or a Facebook vendor selling “clean, ex-UK” MacBooks and Google Pixels. You hand over your money, get a handwritten receipt with an informal 30-day “shop warranty.” If the motherboard dies on day 31, you are entirely on your own. Or worse, you’re forced to pay for repairs that should have been covered.

Most of us have accepted this as standard practice, but the government is finally putting its foot down to protect everyday consumers.

The Communications Authority of Kenya (CA) has released new guidelines under its Communication Equipment Vendor (CEV) Class Licence that set strict consumer protection rules for all gadget retailers across the country.

What are the new CA rules?

Under the new regulations, every single vendor selling low-power electronic equipment ranging from mobile phones, tablets, and laptops to set-top boxes and tracking devices must adhere to strict operational standards. Here are the key mandates that directly impact how you buy devices:

- Mandatory 1-year warranty and return policy: Every device sold in the Kenyan market must now come with a minimum one-year warranty and a clear return policy.

- Strict labeling for refurbished units: Vendors selling refurbished or foreign-used gadgets (ex-UK, ex-US, UAE) must ensure the packaging is clearly and permanently marked as “Refurbished” in a manner visible to buyers.

- Mandatory after-sales support: Sellers are legally required to provide after-sales support and handle repairs throughout the entire warranty duration in liaison with licensed distributors.

- Detailed official receipts: Receipts are no longer optional scribbles on a scrap of paper. Every purchase (physical or online) must explicitly list the seller’s business name, exact device model, serial number, and warranty period.

- Verifiable online sellers: Social media and online vendors can no longer operate anonymously; they must disclose a verifiable physical address, email, and phone number for customer support and complaints.

- Authorized sourcing and type approval: Retailers can only source equipment from licensed Communications Equipment Distributors and sell devices that are type-approved by the CA.

If vendors think they can ignore these new terms, the CA is backing them up with serious financial teeth. Retailers caught violating these conditions face minimum fines of KES 500,000 or 0.2% of their annual turnover. Furthermore, vendors must maintain transaction and warranty records for at least three years and grant CA inspectors access to audit their premises and systems.

The refurbished market is finally under the spotlight

The requirement that caught my attention isn’t even the one-year warranty. It’s the government’s focus on refurbished devices.

Walk into many laptop stores or phone shops today and you’ll find “ex-UK,” “ex-US,” or “Open Box” devices. Google Pixel phones, iPhones, Samsung Galaxy flagships, MacBooks and business laptops have become incredibly popular because they offer flagship performance at a fraction of the original retail price.

There’s absolutely nothing wrong with buying refurbished hardware as long as buyers know exactly what they’re getting. Unfortunately, that’s not always the case. That’s why the CA now requires vendors to clearly and permanently label every refurbished device as “Refurbished” before selling it to consumers. Even more importantly, those devices must still come with the same minimum one-year warranty and return policy as any other qualifying gadget.

That’s a significant win for consumers. Too often, buyers only discover a device has hidden issues weeks after purchase, only to learn their shop warranty expired after 30 or 90 days. These new rules raise the minimum standard for everyone.

The new licence goes beyond repairs. They must also provide customer support, establish complaint-handling mechanisms, keep compliance records for at least three years, ensure advertisements are truthful, and even guide customers on environmentally responsible disposal of old electronics.

Online sellers haven’t been left out either. Any vendor operating online must provide a verifiable physical address, email address and telephone number so customers know exactly where to seek help if something goes wrong.

Will this change the way Kenyans buy gadgets?

I think it should. Kenya has thousands of small independent gadget retailers. Many provide excellent service, but others operate with little accountability, offering short warranties or charging customers for repairs that arguably should have been covered. These new rules don’t eliminate every risk, especially if buyers purchase from unlicensed sellers, but they establish a clear baseline for what consumers should expect.

Perhaps the biggest impact will be awareness. Many Kenyans simply don’t know what protections they should have when buying electronics. By publishing these licence conditions, the Communications Authority isn’t just regulating vendors, it’s signalling to consumers that they have rights. If properly enforced, the days of accepting a one-month shop warranty as the norm could gradually become a thing of the past.

And in a market increasingly driven by refurbished smartphones, imported laptops and premium devices from overseas, that’s a welcome step in the right direction.
